Working Out Custody: Why You Should Hire a Divorce Lawyer

So you've hit a wall. You've exhausted all of your options. And now divorce seems to be inevitable. You have the house. Maybe you can just split that up, right? And you could live in it....or he could, maybe. And time with the kids. Weekends, holidays, a night or two during the week. How are we going to figure out child support? Should you still seek alimony?
...........and the list could go on.
Unless you know the law, you're not supposed to know how to deal with all of this and you might not know about some options that are available to you.
We had a client recently. We'll call her Jen. Jen and her husband Tim have 3 kids. One they each had before their marriage, one together and each parent has sole custody of their respective child. The oldest is about to go to college and the youngest is 9. Jen and Tim have known there were issues. They tried counseling and divorce at this point just felt like the better thing to do.
The first thing we did was sit down with Jen, our client, and talk to her about her options. She was really concerned that she was going to look like 'the bad guy' if she was asking for too much time but then realized that the kids needed to be given as much of an uninterrupted routine as possible.
The real issue for Jen (and she knows for Tim too) is the kids. The divorce is going to be a big change for them. They want to keep them in the same school and also want them to still be together because they've grown up together for the past 12 years.
After a bit of negotiating, we've worked out what we think is a great plan. Jen and Tim both are in agreement and their next step is to discuss it with the kids. We've provided a bit of coaching and although it probably won't go perfectly, it will be the best for everyone over time.
It's important to realize that when it comes to a divorce, the impact on the children might be more than the impact to you so be prepared to be there, be compassionate and understanding and most importantly, allow your kids to be heard.
